Welcome to usedcoffeegear.com ("the Site"), a marketplace for buying and selling used coffee equipment. By accessing or using the Site, you agree to comply with and be bound by these Terms of Service ("Terms"). Please read them carefully. If you do not agree to these Terms, please do not use the Site.

1. Acceptance of Terms

By accessing and using the Site, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing the Site.

2. Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting to the Site. Your continued use of the Site after any changes are posted will constitute your acceptance of the revised Terms.

3. Eligibility

You must be at least 18 years old to use the Site. By using the Site, you represent and warrant that you meet this age requirement.

4. Account Registration

To access certain features of the Site, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.

5. Buying and Selling

5.1 Listing Equipment

  • You may list used coffee equipment for sale on the Site.
  • You must provide accurate and detailed descriptions of the equipment, including any defects or issues.
  • You agree to keep your listings up-to-date and to remove any equipment that is no longer available.

5.2 Buying Equipment

  • Usedcoffeegear.com does not buy or sell the equipment which is listed on the Site.
  • When you purchase equipment listed on the Site, you enter into an agreement with the seller of the equipment and agree to pay them listed price and any applicable shipping and handling fees.
  • All sales are final unless otherwise specified by the seller.
  • The Site is not responsible for the quality or condition of the equipment listed by users.
  • The Site is not responsible for honoring any agreement entered into with the seller of the equipment including but not limited to providing any warranty or after-sales service for the equipment.

6. Fees and Payments

  • We may charge fees for certain services provided on the Site. You will be notified of any fees before you incur them.
  • All fees are non-refundable unless otherwise stated.

7. Prohibited Activities

You agree not to:

  • Use the Site for any unlawful purpose.
  • Use the Site for any purpose other than as a marketplace for buying and selling used coffee equipment and other associated paraphernalia
  • Post any false, misleading, or fraudulent content.
  • Post any obscene, objectionable, violent, discriminatory or hateful content
  • Engage in any activity that interferes with or disrupts the Site.
  • Violate any applicable laws or regulations.
  • Harass, abuse, or harm other users of the Site.

8. Content Moderation

The moderators of usedcoffeegear.com reserve the right to remove any content, suspend or permanently ban any account at their sole discretion. This decision will be final and not subject to appeal.

9. Sales Outside the Site

Any sales or transactions made between users of the site will be made outside the Site are conducted at the sole risk of the parties involved. The Site is not responsible for any issues that arise from such transactions. Users of the Site including both buyers and sellers are responsible to use appropriate measures such as a third party escrow service or shipping insurance and other reasonable measures to mitigate their own risk and to protect their own interests.

10. Intellectual Property

The Site and its original content, features, and functionality are and will remain the exclusive property of Coffee Gear Exchange and its licensors. The Site is protected by copyright, trademark, and other laws of both the United States and foreign countries.

11. User Content

By posting content on the Site, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content.

12. Disclaimers

The Site is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the operation of the Site or the information, content, materials, or products included on the Site. To the full extent permissible by law, we disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.

13. Limitation of Liability

In no event shall usedcoffeegear.com, its directors, employees, or agents, be liable for any indirect, incidental, special, consequential, or punitive damages, including, but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Site.

14. Indemnification

You agree to indemnify and hold harmless usedcoffeegear.com and its employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to the Site, or from your violation of these Terms.

15. Governing Law

These Terms shall be governed and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Site shall be resolved through binding arbitration in accordance with the rules of the Australian Centre for International Commercial Arbitration (ACICA).
